These conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the conditions set out below. If you do not agree to be bound by these conditions you may not use or access this Website.
Before you place an order, if you have any questions relating to these conditions please contact us by e-mail or telephone.
You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.
You warrant that:
The Trade Information which you are required to provide when you register as a trade customer is true, accurate, current and complete in all respects; and You will notify us immediately of any changes to the trade Information by contacting us by e-mail, or telephone. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
www.heatandgas.com are merchants to the trade only. By accepting the terms and conditions you are deemed to be a trade customer.
You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.
Purchase of products
Description of products
Each Product purchased is sold subject to its Product Description. We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy.
All measurements are given in millimetres, centimetres or inches and are taken from the maximum points of measurement unless otherwise stated. BTUs are given in Delta T50 or Delta T60 any queries email or telephone.

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.
The technical steps required creating the contract between you and us are as follows:
You place the order for your products on the web-site by pressing the confirm order button at the end of the check-out process. You will be guided through the process of placing an order by a series of simple instructions on the web-site.
We will send to you an order acknowledgement email detailing the products you have ordered and whether they are held in stock or are required to be ordered and likely despatch date.
As your product is shipped from our warehouse we will send you a despatch confirmation email.
Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with our conditions set out below.
Non acceptance of an order may take place in the following circumstances.
The product you ordered being unavailable from stock.
Our inability to obtain authorisation for your payment.
The identification of a pricing or product description error.
You not meeting the eligibility to order criteria set out in the main.
- If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address of the problem within 60 days of the date on which you ordered the goods (unless this is not reasonably practicable).
If you notify a problem to us under this condition, our only obligation will be, at your option:
- To make good any shortage or non-delivery;
- To replace or repair any goods that are damaged or defective, No liability is accepted for any installation costs incurred; or
- To refund to you the amount paid by you for the goods in question.
- Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract. Neither party shall have any liability to the other party for a claim of loss of profits.
- You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
- Please be advised that you need to comply with all applicable regulations and legislation and where applicable you are responsible for ensuring all that only suitably qualified tradesmen are engaged to install goods purchased from our site.
- Notwithstanding the foregoing, nothing in these terms and conditions affects your statutory rights.

Refusal of transaction
We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
To be eligible to purchase Products on this Website and lawfully enter into and form contracts on this Website under English law you must:
Register by providing your real name, phone number, postal/delivery address, e-mail address, payment details and other requested information
Possess a valid credit or debit card issued by a bank acceptable to us.
By making an offer to buy a Product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise Trade purchase transactions.
We will treat all your Trade Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation from time to time in place.
When you shop on this Website, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, billing address, delivery address, telephone number, product selections, credit card or other payment information and a password. When you create a shopping account while ordering online you will be given the option to receive information from DDD by post, e-mail or telephone, about products, promotions or special offers which we feel may be of interest to you. In the event that you do not wish to be contacted for such purposes please e-mail or telephone.
Your trade Information may be disclosed to other reputable third parties who will help process your order. DDD requires all such third parties to treat your Trade information as fully confidential and to fully comply with all applicable UK Data Protection and Trade legislation from time to time in place. We will not release your Trade Information to any company outside of heatcodirect.com for mailing or marketing purposes.
You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your trade Information and or User Information we are entitled do so.
SHIPPING & DELIVERY
Our standard delivery charge on all orders to mainland UK are free except for radiators or your order is below £100.00
Delivery applies to UK Mainland only. Postcodes KY.PA1-18.FK.AB.DD.KW.PA-19-40.PH.IV will incur extra delivery charges.
Stock items are normally despatched within 3-5 working days. Please allow up to ten working days for the receipt of your goods. For out of stock items we will advise you by e-mail or by telephone on the progress of your order and the likely delivery date.
Delivery will take place during normal business hours Monday to Friday. Weekend deliveries can be arranged but these will be charged at the couriers cost over and above the standard delivery charge.
Bulky / multiple item deliveries.
Bulky item delivery will normally be made by a single driver. For Health and Safety reasons the driver cannot move heavy items on his own. If your order contains heavy items please ensure that there will be at least one able bodied person present to help you move your goods.
Checking Goods / signing for goods
You must or Someone must be available to sign for the goods during normal working hours and this person should be known to you. We will not be responsible where the person signing for the goods is not the person who has placed the order/paid for the goods or the incorrect address details have been supplied. check the goods for damage before signing the drivers delivery note.
You must open the packaging and thoroughly inspect the goods. Sometimes the paperwork may say sign if the outer packaging is intact. PLEASE IGNORE THIS, If you sign for the goods, even if you write the words Unchecked or similar on the delivery note, then you are accepting that the goods are in good condition and later claims for damages CANNOT be considered.
If the driver refuses to wait while you check the goods then you must sign the carriers note as DAMAGED and ACCEPT the delivery and contact us with the details IMMEDIATELY on 01254 234811 or e-mail.
Any items not received must be advised within 7 Days of the despatch confirmation e-mail in order that this can be investigated. We will not be responsible for any non delivered items after this time or failure to advise us accordingly.
Notwithstanding the terms of the respective clause of contract, notice in writing of any loss-damage must be marked on the delivery note, or and on the carriers proof of delivery note on reciept of the goods and must be notified of any loss, damage or shortage within 48hrs of delivery.
The Carriers state that they will not be liable for any loss or damage arising from any cause whatsoever unless the PODs are marked clearly on reciept of delivery and they are notified within time stipulated above.
If we are not notified of damage within 48hrs we are unable to claim from either the manufacturer or the carrier. You agree to indemnify us in full for any losses we suffer as a result of your failure to notify us within 48hrs.
When the goods have been opened, in front of the carrier and the goods are found to be short or damaged please accept the goods and sign accordingly as per our terms and conditions. See Checking Goods / Signing Goods. Contact us immediately and we can arrange for the goods to be collected at a later date. Do not return opened goods without contacting us first, or you will be responsible for any lose or damaged to the goods.
RETURNS & UNWANTED ITEMS
We guarantee your satisfaction and all products (except Ultraheat Radiators) come with a 7 day no quibble guarantee. If you wish to exercise this option you should contact us by e-mail in the first instance. Returns should be made in the original, undamaged, unopened, packaging and with all the tags intact. We require goods to be returned by Royal Mail and recommend they are sent by registered or insured post. We will not be liable for any loss or damage incurred whilst returns are held by third parties. Refunds will be made once the items are received by us and a confirmation e-mail will be sent advising the refund amount. At our discretion we reserve the right to charge a restocking cost of up to 50% for any unwanted or incorrectly ordered item that may be returned, that are not covered by our guarantee. Products returned outside of 28 days will not be accepted.
Due to health & safety reasons items such as steam showers, whirlpool baths, gas boilers cannot be returned if they have been unpacked
We reserve the right to withhold a percentage of the refund value of returned goods if the product or packaging is in such a condition that the item needs to be reduced in price for resale.
Postage costs will not be refunded. Where items have been sent but postage has not been charged any refund will be credited, less the actual cost of delivery. Some items (e.g Ultraheat Radiators) have a subsidised delivery charge. Any subsidised item returned will incur a standing charge on the return of said goods.
We will only refund the card from which the original payment was made.
